US Government's statement of interest
The other interesting factor in this is the "eminent domain"-style statement of interest files by the Government late in 2005. I posted a description and analysis of what it means to any possible injunction here:

RIM Says they have a workaround.
If they have a workaound why not use this time to start pushing it out and allow black berry administrators time to get in place befor the cut off date. That should solve at least 50% of there users problems.
