RIM fires latest suit at Good

Research In Motion said Wednesday it filed its latest lawsuit against rival Good Technology in an ever-escalating court battle.

The lawsuit, which is the Waterloo, Ontario-based BlackBerry maker's third in a little more than a month, alleges Good "engaged in unfair competition, false advertising, trademark infringement and trademark dilution resulting in the unlawful use of the RIM and BlackBerry marks." RIM has filed its lawsuits in U.S. District Court in Delaware.

RIM filed a separate lawsuit earlier this month, alleging that Good is infringing on patents for its BlackBerry e-mail pager. In June, RIM filed another patent infringement suit. In an effort to pre-empt RIM's suits, Good asked a U.S. District Court in California to declare RIM's patent on a technology called "single unified e-mail" invalid to clear the company.

Good Technology released its first products in May and its Web site urges BlackBerry users to upgrade to its GoodLink wireless corporate messaging system, which runs on RIM hardware.

The volley of lawsuits may not be over since RIM hinted in a statement that there may be more on tap. "RIM is continuing its review of Good Technology's goods and services to determine whether any other rights are violated," the company said.

RIM is asking for injunctive relief and monetary damages. The company also alleges that Good's patent infringement is "willful" in an effort to boost monetary damages and attorney fees.

The suits come just weeks after RIM cut its revenue targets for its fiscal year. In RIM's first quarter ending June 1, the company reported a net loss of $10.8 million, or 14 cents a share, on revenue of $71.6 million.
