An article a few months ago stated that since the initial court had already ruled, only "appeals" concepts are now allowed. Since the rejects are still to be argued back and forth for the next couple years, the appeals court can't use the rejects in its ruling. If the rejects were made permanent, then the appeals court could use the rejects.
A lawyer friend told me that the lawsuit and appeal process is extremely fair and proper to both sides - if they have money. The problem is our Patent Office doesn't have the money or career attraction to hire competent technologists.

Blackberry system immediately and totally. NO exceptions. Then
we'll see who can scream the loudest
I'd rather see NTP shutdown - that would resolve everything and keep 99.5% of the people involved in this situation happy.
