ISP wins against spammer

A New York state appeals court ruled last week that Internet service provider PaeTec Communications may discontinue access for customer MonsterHut, reversing an injunction that prevented it from cutting service to the direct marketer. The judge ruled that MonsterHut used Rochester, N.Y.-based PaeTec's high-speed pipes to send unsolicited commercial e-mail in violation of its contract and PaeTec's acceptable-use policy.

The ruling comes almost a year after a New York state judge granted a preliminary injunction against PaeTec, questioning the nature of agreement between PaeTec and MonsterHut. In Friday's decision, the court said it had erred in its previous judgment to grant an injunction against PaeTec.
