just as amazing as creative's zen patent lawsuit against apple about
it's folder hierachy system, basically the same system that's used in
every menu system, i believe apple's countersuit is just to pressure
creative to drop their stupid and over blown suit.

Apple went through a famous sue-happy phase back in the 80's (anyone remember those ?look and feel? lawsuits?) Such tactics eventually backfired and destroyed the company.
Do you think Apple can make the same mistake again?

This is stupid.

Apple's bitter because Creative beat them to the punch on these players by *YEARS AND YEARS*.

Creative's bitter because the market has chosen Apple's product over theirs, and winning side-by-side reviews doesn't change that, no matter how much better they may think the Zen Photo is than any iPod. (Which I agree with, but that doesn't really matter, now does it?)

They both just need to get over it and continue to make the best players they can.

Silly and dangerous

This whole patent thing is getting out of hand. Truly trivial things are being patented in outragous numbers. If you tried to get something to market you would not even know if you were infringing on some existing patent. You'd find out the moment you're getting sued by some fool company who is afraid you might be a danger to them. In the end the only ones being able to get some business done will be the law-firms I guess!
