So... is everyone just sue-happy these days? First people start
bringing lawsuits against Apple for the iPod Nano scratches, now
they're doing the same with Microsoft's XBox 360 crashes. I
mean, are these isolated cases REALLY causing you enough
emotional damage to take someone to court over it?

Hmm... I wonder if I can sue the maker of my car since it doesn't
get quite as much gas mileage as they state. Or the editor of the
latest Harry Potter book since it had a dozen or so spelling erros
in it. And while we're at it, my eyeglasses aren't COMPLETELY
scratch-resistant...

I'm sure that these reported incidents of class action lawsuits only 'appear' to be happening so frequently because the media (and not just CNET) finds it worthy enough to announce it because it's pure and simple sensationalism.

The media themselves know that the plain idiocy of the lawsuits is enough to drive people into a bit of an uproar. And while the media's job USED to be to report the news, it's job is now nothing more than to see who can tell the most 'fantastical' stories to get the most people to respond to it. This in turn reflects to the advertisers that the particular media outlet has enough of a reader base (or viewer, or listener base) to make them want to advertise. Overall, it's nothing more than sensationalism that leads to typical greediness.

Some guy, for fame or fortune, one fine day woke up and decided to sue MS, and CNET was there to dedicate a entire article on that. Its now common knowledge that CNET and its editor has a anti MS bias. CNET one of the very few sites to have even featured an article about some guy suing a company over an allegedly defective product, it?s not even a class action suite. I am sure this comment would soon disappear (and guys in black suite will soon appear outside my house) ;)

Like many other people have said before (I would think people would get it by now), Just wait. Wait to get the new console once "they" (i say they cuz all companies have problems with the first gen systems lately) have gotten the bugs out and the price goes down. Makes for a better gaming experience and it's cheaper. More games will be out then too and that's what it's all about, the games right?

Seems like more people are concerned with bashing Microsoft for past problems than actually playing games. If you care so much about what microsoft "does wrong" than don't buy their stuff. Wait and get a Ps2 or Nintendo revolution. Stop wasting your time posting jabs at MS and do something with your life.

New Microsoft Product = Wait a Year

It's my philosophy that, when buying or upgrading Microsoft products, I usually wait about a year before I buy it. This is because, time has shown, that it is inevitable that MS will have glitches in the first release of a new product, or have many upgrades. It will take some time before the XBox 360 is 100% ready. This first group who got the XBox 360 is what Microsoft Calles "Codename: Secret Public Beta".

On another note, anyone Remember Windows ME? MS Rushed that out so fast to get it out by the Millennium and look what happened. Can you say BSOD? Same situation with XBox 360 - Rush to get it out. Did MS mean for this to happen, no, but should they have seen the problems coming = YES.

Fast time 2 market => MS's problem

If you ship a product that apperently needs a "special room/
area" for the power supply alone, you have to take the blame
and learn from it.

Zilliions of consumer goods people will tell you that nobody
wants an extra cabinet to fit your home entertainment center. I
want it but I only want to see it on screen. All else is techo-
masochism.

In other words, MS did it again! As a mainstream gamer I'll wait
for a better device to hit the market (i.e. one that doesn't
overheat and possibly burn my house) that actually is somewhat
invisible and actually works within the constraints of a non-geek
house. Hopefully the gusy & girls at Sony understand!

Sueing MS? It's soooo American. Living in Europe I'll just vote
with my wallet ;-). Now to find a good excuse for a PS3....
Suggestions are welcome ;-)

Sorry kido Sony?s PS3 will come with its own set of issues. Do you think Sony isn?t dying to get into the race after being left behind? No matter the issues some user are having Xbox is a runaway hit. Folks are paying over 100% premium to get one, check out eBay. Sony?s products are in no way immune to defects, forgot the rootkit fiasco? Even PS2 came with a lot of issues even though then Sony wasn?t under so much pressure. Wait and see.

He wants money for "damages"? What damage has he suffered? Certainly if the unit he owns is defective, Microsoft should replace it but that is covered by a normal default warranty and does not need a lawyer to see it through.

Clearly he hasn't followed up with the warranty first, not enough time has passed to allow it to be covered and replaced if needed.

The damage is all in his mind. Just because he was one of the early adopters of the XBox 360 and he cannot enjoy it he is scarred. This guy probably lost sleep and skipped work so he can buy and play the 360. He wants MS to pay for his mental and emotional anguish of not enjoying the fruits of his labor. When all he needs is a couple pills to control his ADD long enough to ready the warranty, grab his reciept, and go ask for a refund or exchange. :)

microsoft is haveing same issues as ps2 @ it's launch. you think Sony is perfect, than think twice. i need to update psp also to gain new feauturs and patch voulnarabilitis. that is just NG!

I bet these goofs are covering the vents with game cases or putting the boxes in tight, poorly ventilated spaces. I guarantee that will burn it up. The thing has -three- processors. That's a lot of heat to dissipate!

do not think if you buy cisco pix that it will not overheat. 506e is hot with it's celeron inside. if u jam it inbetween other devices it will melt. "Cisco has determined that the affected power adapters could overheat, potentially leading to a fire hazard or electric shock hazard."
any hardware will do this.

I have had it with the xbox 360. All we get told is lies. The machine never worked from day one. Contacted customer service and they were going to send a box so we could send it back and get a replacement. Waited a while called back, system closed the ticket opened a new one and was told it would be shipped over night. Never came called back and was told they do not do that, asked for the tracking number they promised and was told that they only ship reqular mail. Not what I was told at twice before. People in canada should follow the lead and also Launch a class action lawsuit.

The quote is lifted from the story linked below which, curiously, seems to vanish after a couple of seconds only to be replaced by a general list of search results ...

The quote not only proves their attitude towards putting out new products (ie. knowingly releasing products with defects) but also shows they do not deserve their exalted position of being the monopoly they are.

Is the XBox360 really a console?

These consoles need to be built as consoles. Consoles have always been stacked in entertainment centers and placed on top of the cable box. My Atari 2600 and NES set on the cable box for years without a problem. If the Xbox360 can't find a home there, maybe it is a fraudulent console.
If the Xbox 360 was not meant to be housed between two other devices why would it have a front loading DVD? Also if it needs clearance on the bottom you would ad feet on it that would allow airspace.
Does anyone have a manual that states how much air clearance the console need or is this net mention in the manual?
These are the only things that would protect a manufacture from product design defects.
