Offer the free case to all the existing Nano owners and completely diffuse the class-action suit. Nice tactics.

I don't agree with the lawsuit's premise

We bought one of the Black iPod Nano's almost as soon as they
were available. One of us takes it to the club whenever we
workout (thats about 6 times a week, between the two of us).

The Nano still looks perfectly new (I just checked it before I
wrote this). There are no scratches (that I can see) on the screen.
There are a couple of tiny scratches on the back, but you have to
really look closely at it and move it around in a strong light to
even see them.

I don't know what these people who are suing are complaining
about. I don't see any scratch problem with our Nano.
