How's that again....? This quote is given in the context of a previous ruling by the same court regarding the PETA.org domain ("But the same appeals court in 2001 ruled against the operator of a Web site, then at Peta.org, that parodied the acronym for animal-protection group People for the Ethical Treatment of Animals by renaming it People Eating Tasty Animals.")
The fact is that the Falwell ruling is not a shift in the thinking about trademarks and domain names. This is a ruling which is consitant with the liberal philosophy of "Liberals are right, conservatives are wrong; Liberals must always win, conservatives must always loose." Within the context of this philosphy, there *is* no shift in thinking at all; The two rulings are consistant with each other and with that philosphy. In *this* context, anyone who believes that the courts are going to be more friendly to the 'little guy' in domain disputes is mistaken.
