eBay Gets Its Just Desserts

I am a seller on eBay. Personally, I think eBay is free enterprise at its best. Anyone can sell just about anyhing on eBay. Nowhere else can you find such a wide variety of goods and services, all available to the highest bidder!

Unfortunately, I have also witnessed a gradual crumbling of its infrastructure. Under eBay's "new and improved" billing system, sellers who generate $15 to $20 in fees are getting bills for $200 to $300 and more. Corrections to these errors sometimes take months. The billing system has run amock. Unilateral changes in category structures have put hundreds of sellers who depend on the income generated by eBay sales out of business. The sad thing is, the sellers are getting steamrolled by corporate greed.

I wholeheartedly support the efforts of these brave individuals who are leading the way to justice for all of us. Someone has finally spoken up and said, "Enough!" My respect and admiration are tempered, however, with melancholy. It didn't have to come to this. How sad...for us all.

At last - the arrogant ones get theirs!
by July 6, 2004 7:30 PM PDT
I have never purchased anything from eBay as a result of my observation of a friend's terrible experiences. The view of eBay through his e-mails showed me a company that was absurdly rude and heavy-handed, completely money (not service) focused and as rule-bound an old Soviet Comissar. I am not surprised at the experience of these two individuals who are bringing suit - the feel of this case had such a familiar ring to it. It was the same theme - eBay insisted my friend owed them money that he had already paid.

In my experience, eBay acts like a bunch of bullys who will gladly conduit online crooks into your living room for ridiculuous fees. If you have a relative who is an addicted eBayer, do him/her a favor and point them to Pricewatch - you will save them their money and dignity.

It is about time that...

Personally, I have been selling on eBay for only a short time but can say without reservations that both eBay and PayPal need to be regulated. It is clear that neither company is going to do what is right by their customers be they sellers or buyers. PayPal wants to act like a bank and a credit card company but doesn't want to follow any of the rules, especially when it comes to payment disputes. Both companies need to be dealt with and harshly so that they can become companies that both sellers and buyers can look up to and be confident that everyone is being treated fairly. Until that happens they come across as scam artists and crooks.

I too have been selling on ebay for quite a while now, and honestly, they seem to try to protect buyers but as far as protecting sellers, we're left out in the cold! Paypal Stole $340 + of my hard earned dollars, with no where to turn, apparently they are a payment processing center, yet pass themselves out as a credit card center. They really should be regulated!

First I would like to take my hat off the people bringing the lawsuit against ebay. Any time that they have to be held responsible for their disgraceful mismanagement and lack of business ethics is a very good thing.

I used to use ebay to purchase a few things, but I got burned for about $200.00 after many tries of trying to recoup my loss with ebay and paypal. I just gave up. I have never used them since and try to voice my opinion about them to who will every listen. I don?t know if they have changed how they do business I don?t care. I will never darken their web site again. All I can say is hurray and take them for all you can. I want to read more stories like this. It makes my heart swell with so much joy.

I agree with Mr. Meyers 100%, hell, If I could have my day in court, I'd take them for all they have. I have been screwed by paypal and guess what, there is no way to fight them, unless you want to hire a lawyer! There is no process for one to fight them, unless you can file a class action suit, and then, the only one's that win in the end, is yes, the lawyers!

PayPal and Ebay support fruad !

I just finish winning an auction on Ebay and went to pay for it using the <PAY> button on the screen. When I went to pay using my PayPal account it would only allow me to pay using Direct Transfer or eCheck, the two least secure methods. When I finally got in contact with Customer Service I was told that PayPal employs analytical safeguards to identify patterns of high-risk transaction behavior in their system. I asked if there was a problem with my account or credit card, she replied "No." I asked her what variables they were using to determine this she said she did not know. I asked how using Direct Transfer or eCheck protects me the buyer and she replied, ?it doesn?t.?

PayPal offers no protection for using Direct Transfer or eCheck so if you end up being the victim of a scam which is becoming an epidemic on Ebay you?re out. PayPal?s so called Buyer Protection is another scam because you have to pay a fee for it and most of the time they will find a way to disqualify or dismiss a complaint. PayPal and Ebay are in the business of scamming both Buyers and Sellers. It?s no wonder why Ebay has had to adjust their earning projects in recent days. People are quickly finding out that they facilitate the fraudulent actions on their website and then play dumb. Their purchase of PayPal was just to increase their money making scam. The Federal Government needs to get involved and shutdown Ebay and Paypal.

I just had a terrible experience with Paypal which is owned by Ebay. A buyer purchased a telecom gateway from us. We tested the unit before it was shipping. The sales ad we posted, did not list any accessories, only the box and the guarantee was that it would not be DOA, and if DOA, had to be reported in 3 days, and would be exchanged. The buyer did not report it DOA within the 3 days. After his receipt, he did not know how to use it so we gave him FREE tech support from our techs at our telecom NOC in Panama online. Do use the gateway, he had to have a static IP address from his internet service provider and he was advised of this. Almost a week later, he still could not provide us with a IP address that we could use to configure it for him remotely. He hired a computer technician, who would not know anything about VoIP telecommunications to try to help him configure the equipment and they opened the gateway case. Then he filed a complaint with Paypal without even telling us that he felt there existed a problem with the equipment. We still tried to assist him so that we could confirm if the gateway was damaged and he refused to take it to someone that could connect it to a static IP address. Paypal took my statement online and that was on April 15. Today, June 2, I got a email from Paypal that they had ruled in the Buyer´s favor and that he was to return the gateway and they would deduct the cost of the equipment plus S&H from my account, $890. I called them and found that they would not listen and have no appeal process. I told them that the man had not followed the rights of warranty, but beyond that, he had tampered with the equipment physcially opening the case and no one has to guarantee anything after that point as he could have been at fault, if there was anything wrong. Why? Because possibly he could not use the equipment and simply was trying to find a way to get his money back. They said that their decision was FINAL and not possible to appeal. She told me that once he confirmed it was shipped and provided a tracking number that they would pay him my money, once they confirmed it was shipped. I asked, well how do you know it is shipping, because he could put crap in the box and not even ship the equipment. She said that if he does that, I should go to the police, file a complaint and send them a copy of it. I said, "well that is telling me that you do not have a secure method of doing this and you give him his money and then I am supposed to fight with the police to get it back later and you are not taking any responsibility, yet you are aiding and abetting him in the potential commission of fraud." She repeated that this is their procedure. I said, "looky, I am advising you that your Buyer client was perpetrating a fraud, you approved his complaint where he could accomplish this goals, now you are telling me that although you took 7 weeks to make a decision, you never inspected the equipment nor had anyone inspect the equipment, there was no written guarantee beyond the 72 DOA provision, and even then the guarantee would have provided a replacement unit and not a cash refund, that not only are you going to give him back all the money, that you are making a unilaterally judgement that even changes the original contract of sale, and you are weighing the remittance of cash based on him only producing a tracking number...that you assume that you have ZERO responsibility as a third party????!!! She said yes. So, now I have legally advised you that a fraudulent transaction is in process and you are assisting him and allowing him to perpetrate the fraud and instead of notifying your fraud department, and stopping this from continuing, you are telling me that I must wait for him to F$/%/%k me and then report the theft you are going to complete for him. She said that they had made a decision and this was not reversable!!! I said, well I must be speaking to someone of high intelligence because your thinking is absolutely beyond my capacbility to comprehend--goodbye!

You are not going to believe what has transpired in the one month since June 2. The Buyer sent a package (whether it contained the product he bought is unknown) to Panama where I live but he addressed it to a technician that worked for me. Why would he do that? Was that to be able to say he sent it but someone else intercepted it or was it a mistake? Ha! Anyway, Fedex returned the package to him. Paypal sent me an email that said since they had no evidence the package was returned to me that no refund was warranted and that the ruling was now in my favor, the Seller. They said "this decision is final." A couple of days later, I got another email from them telling me that I still had to refund because the Buyer tried to send the package to me. HA! The next days they sent me an email asking me to provide tracking info as if they had me confused with the Buyer. the next day they answered me finally and said that they had reversed their ruling. The next day, they could not explain to me how it was that although they can not reverse decisions, without fraud. that they were doing so anyway. this has now gone on 3 months, they have already refunded some money I had in my account to the Buyer and they still have not resolved.
The fact is, Paypal is disorganized and the staff are completely incompetent and unqualified to be making financial decisions. And no one there really has the brains to make a honest decision. The state attorney general should investigate them for fraud!

Correct this, or shut them down!

Pay Pal uses an automated program that searches and links accounts designed to assign liability to a related party when accounts are in violation of Pay Pal policy. If a member's account is derogatory or is in an adverse standing with Pay Pal, any other member with similar search criteria such as last name, matching previous address, or several other criteria (deemed confidential by Pay Pal representatives), will have their account access restricted until such issue is corrected. This is the tricky part, there can be no connection at all between these accounts and yet the financial liability is automatically transferred. In fact Pay Pal will debit a members account to pay for the negative balance of another unrelated member's account. (This sounds wrong, but it is how they conduct business: They will take money from you to pay a stranger?s debt, and/or halt your ability to conduct business if some other unknown member of Pay Pal has a negative account balance...) This is illegal, as in any transaction protected by federal and contract law, all parties much agree to the terms and in this case, must actually be liable for the debt. In conversation with a representative named Scott in the account review department at Pay Pal, it was stated, that the stand of Pay Pal was that they are not a bank and do not have to abide by Federal Banking Laws. In fact Scott was so confident that the actions of Pay Pal were not in violation of any federal banking or trade law that as a representative of Pay Pal, he was compelled to terminate phone calls with members at will and terminate accounts without review when faced with questions concerning tort interference with a member's business. The circumstances surrounding the conduct of how Pay Pal and their parent company Ebay conduct business must be investigated and controlled. This issue will persist unless regulation and investigation is initiated. If consumers, regulatory agencies, and media are not made aware of such illegal practices by large autonomous, multi-national companies, then banking or FDIC pass though violations and FTC violations will continue to harm businesses and individuals. We would like to see an investigation into why Pay Pal suspends a business banking account (which is what this is, complete with a debit master card) and halts a companies ability to conduct business, pay bills, function financially, and attempt to illegally pay anther members debt with private money.

Paypal supports FRAUD, yes it does!!!

I have recieved an item not as described at all. It was NOT for my car and had NO instructions. I told paypal, and they said to send it back to the seller with proof of shipment. I sent it back, and provided my proof, multiple times. Paypal claimed that the shipping information was invalid, with no reason. The shipping information was valid, and i called paypal, and the representative there told me that it was valid, and to write another e-mail to paypal describing the situation. I did what she said, only to recieve replies telling me that I provided the shipping information too late. Paypal knows how to beat around the bush, and did nothing about the fraudulent seller who is still selling on eBay with many negative feedbacks. I paid for an item, and paid to send it back, for nothing in return at all. The seller got this money from me, and recieved his item back which he will probably sell again the same way. I cant believe the audacity, and nerve that paypal has displayed to me. It is obvious that they care about nothing but themselves and how they can make more money. SOMETHING NEEDS TO BE DONE!

Yes, Just go to google.com and type in 'how to sue paypal'. you see that you can sue them. i saw a guy back in 2000 beat Paypal in a lawsuit. However, Since eBay acquired Paypal. eBay has changed Paypal user agreemnt. Damn, It's very tough to beat Paypal now. Those lawyers at eBay are very goods. Their user agreements prevents all lawsuit (they can suspend, do whatever to your account, refuse to service you without a reason). Basically, You agree for them to do illegal things or you do not get an account period. what's a s*ck a** company.
