The word "originate"
by MrNougat January 25, 2006 5:23 AM PST
In a previous story about this new law, where the pertinent text of the law was included in a sidebar, another commenter pointed out that the law stated that it would be illegal only if a device was used to originate such annoying speech. Technically speaking, web servers do not originate -- the beginning of the information exchange happens when a remote user requests data from the server.

Devices don't originate speech

How does a telephone, a server, a computer, or any other device
originate speech? A dubious case could be made that a pre-
recorded mechanical device originates speech, or a computer that
"reads" text, but it is patent that in all cases genuine speech
originates with a human, or a parrot.

President Bush is only following orders. Every little thing he does and says is. He can't make a move until the shadow government says so.

He's even said he signs laws that he thinks are unconstitutional and
hopes the Supreme Court will sort it out. When will pinochio realize
he's a real boy now.

Erosion...

Wow - look my name is available... which brings the issue to light. Persons intending to harm another person(s) may or may not feel comfortable with "free speech" as a mechanism to allow them to communicate via the internet. What I am tired of are the multitudes of spam and phishing emails that do not have any company address let alone a person to respond to... ie. viagra...! The Bill seems to hone in on individuals who are out to harm vis-a-vis enlighten us with new ideas or discourse that may change intellectual thought progression. But I ask you all - are you really engaging in free speech if you are anonymous? Not at all. Using the internet is this fashion is akin to using a pen name. Hopefully, this type of Bill will transcend itself into stopping all the harassing calls to convert to a different phone or internet provider in Canada. Then, again - everyones takes or perspective on Harrassment is once again foggy at best.
