There are too many frivolous lawsuits against Apple and it needs to stop.

This person suing should just have taken the phone back and said no thank you! Don't they have a 30 day return policy!
If people can sue and get money for being lied too or hurt, good! But seems like a lot of headache.
If this is allowed to go as a class action the individuals that are part of it will get chump change, but the legal firm will get a big payday since they take a percentage of the total payout if there is one, hence the motivation to sue anything that moves.

- Sometimes the only way to change bad business practice is through the courts. Apple is very discrimatory against families with children. The first question out of their mouth when you go in for a repair is do you have kids? and then they proceed to look for any reason that your child did something to the computer. This has happened to me twice and both times - my child was not at fault. Why should they get away with continuing this practice.
