Psystar adds new Mac OS desktop

Psystar has decided to not let a legal battle get in the way of its product road map.

The company introduced the Open(3) Wednesday, which as the name implies is the third model that Psystar has shipped with Mac OS X preinstalled. As you may also recall, Apple has not taken kindly to Psystar's decision to ship such a product, and the two companies are currently exchanging legal briefs and arguments over whether Psystar has a right to sell Open Computers with Mac OS X.

Judge: Psystar can claim Apple 'copyright misuse'

A federal judge is letting Mac clone maker Psystar amend its legal defense against Apple.

Psystar was delivered a blow in November, when Judge William Alsup of the U.S. District Court in Northern California dismissed Psystar's antitrust claims against the Cupertino, Calif.-based Mac maker. The antitrust suit was a response to a copyright and trademark infringement suit Apple filed in July against Psystar, whose OpenComputers are designed to run the Mac OS X operating system.

In its amended complaint, Psystar accuses Apple of copyright misuse, as well as unfair competition violations based on its alleged copyright misuse. … Read more

Want to eliminate Psystar? License Mac OS X

Psystar, the homegrown computer vendor selling its brand of Open Computers with Mac OS X installed, is back in the news this week, thanks to another court filing claiming that it can do whatever it wants, courtesy of the first-sale doctrine.

Psystar contends that because it bought copies of Mac OS X from Apple and its partners, it has every right to install that software into its own brand of computers and sell the hardware to its customers.

Does it make sense? Not really. Much like Psystar's contention that Apple was operating a monopoly and abusing its copyright, the small firm's pleas to courts have been suspect, at best.

And yet Apple continues to play the legal game with Psystar and pay its lawyers to engage this annoyance in court when Steve Jobs has more pressing issues (like running a public company) to address.

Say what you will about the Psystar's court battle with Apple, but there's really an easy solution to all this, if you're Apple: license Mac OS X.… Read more

Psystar is still tilting at legal windmills in its battle against Apple, this time asserting its right to do whatever it wants with products obtained legally from Apple.

New face in Mac clone market plans high-end OS X desktops

A company called EFi-X USA (no, that's not a throwaway droid from Empire Strikes Back) apparently plans to take on Mac clone maker Psystar by bypassing the consumer market and jumping straight to the power user demographic.

The machines it's prepping sound pretty nice, with a 3.8GHz Intel Core 2 Quad processor, 1TB storage on 7200 rpm drives, a 150GB 10k rpm system drive, 4GB of included RAM, and a GeForce 8800 GTS GPU.

Psystar shifts course, says Apple abusing copyright

Having run into a roadblock in its attempt to fire back at Apple, Psystar is changing tactics.

Court filings this week (click here for PDF) indicate that Psystar is dropping its argument that Apple is violating antitrust laws--which Judge William Alsup has already rejected--in favor of a new argument that Apple is abusing its copyright on Mac OS X to stifle competition. The Mac clone maker is attempting to stay in business against long legal odds by trying to convince a court that Apple's licensing policies for Mac OS X are unfair and illegal.
