Apple searched his home for errant iPhone; now he plans to sue

Apple may need to brace itself for a lawsuit stemming from its July pursuit of an errant, unreleased iPhone in San Francisco.

Sergio Calderon, the San Francisco man whose house Apple security officials searched at the time, has ended negotiations with the company and is preparing to file a lawsuit, his attorney, David Monroe, told CNET today.

"The talks have ended and we're moving forward," Monroe said. The next step would be to draft a complaint to file in the next few weeks, he said, although he declined to say what what allegations the lawsuit would raise. … Read more

Friday Poll: No iPhone 5; so now what?

Apple's much-anticipated "Let's Talk iPhone" event came and went this week without the appearance of an iPhone 5. Some consumers expressed no uncertain disappointment about this development ("The S in iPhone 4S stands for Same," one commenter said, echoing other observers' expressions of letdown at not seeing a complete revamp of the smartphone).

Others, such as CNET's Dan Ackerman, took the position that the iPhone 4S essentially is an iPhone 5. Yes, it may be wearing the same outfit as the iPhone 4, but with a dual-core processor, upgraded camera, voice-activated personal assistant, and improved battery life, Dan argues, it is, in fact, almost an entirely new device.

So, here's what we want to know, readers. Now that the mystery's over, you've familiarized yourself with the iPhone 4S' features, and you know we won't be seeing an iPhone 5 just yet, how (if at all) does this impact your phone plans for the near future? Vote in our poll, and be sure to elaborate in the comments section.

Hard Candy bet on iPhone 5 goes south

There you go; there's no iPhone 5, at least not yet. For most of us, this is a typical case of much ado about nothing, a huge hype followed by a letdown. For Tim Hickman, the CEO of Hard Candy Cases, it's also a business gamble that didn't work out. The company sent out an embargoed press release to the press a couple of days ago about its new cases for the iPhone 5, information that was leaked earlier today by the Cult of Mac.

It turned out Hard Candy wasn't sure that there would be an iPhone 5, nor did it know the actual design of the product. Just a few minutes ago, like the rest of us, Hickman was watching the live event from his home, but with much greater trepidation...… Read more

Apple may face suit over search for unreleased iPhone (scoop)

Sergio Calderon, the 22-year-old San Francisco man who accused Apple employees of impersonating police officers while searching his house for an unreleased iPhone, has hired a lawyer.

David Monroe, an attorney in San Francisco, told CNET this evening that he is considering filing a lawsuit against Apple, but, for now, is still investigating what happened.

Based on what he's learned so far, Monroe said, the actions of Apple security personnel and San Francisco police are "outrageous." Apple declined to comment for this article.

CNET reported on August 31 that Apple had enlisted San Francisco police for help … Read more

Sprint iPhone on Radio Shack inventory page

It looks like Sprint will indeed be getting the iPhone 5 soon--perhaps on Tuesday.

Apparently confirming earlier rumors, a screenshot published by Engadget purportedly of a Radio Shack inventory page lists a 16GB and 32GB iPhone 5. It was suggested in early September that a Sprint iPhone 5 was in the offing when an internal carrier memo informed employees of a vacation blackout from September 30 through October 15 due to the "possibility of a major phone launch."

The screenshot also seems to confirm earlier reports from the Wall Street Journal and Bloomberg, which reported that customers would have access to an unlimited data plan.

Apple might give us more information on a Sprint iPhone on Tuesday, when the company is widely expected to take the wraps off a next-generation iPhone during a Cupertino, Calif., press event. Apple sent invitations to the media last week that featured a cluster of four iOS icons and the tag line "Let's talk iPhone." … Read more
