Perhaps the next time Brad Smith heads to Brussels, it will be for a vacation.
After years of wrangling with Microsoft, the European Commission announced an accord with the software giant Wednesday on several fronts that seems poised to put an end to its antitrust concerns with Redmond.

(Credit: Microsoft)In the wake of the announcement, I spoke to Smith, Microsoft's general counsel, about the decision, what it means for the future of Windows, and whether the company sees its spot on the antitrust hot seat now being taken up by other companies, including Google.
Here's an edited transcript of our conversation:
Q: Is this really it as far as Europe is concerned?
Smith: This is definitely a major milestone for Microsoft. Today's announcement reflects a broad set of agreements that really address a wide array of issues. At the same time, we obviously need to keep our eye on the ball. Antitrust issues will continue to be important for us, just as they are going to continue to be important for a number of other leaders in our industry. We're going to have to do an excellent job implementing these agreement. We are going to have to do an excellent job addressing any new issues that arise in the future. Having said all that, I also think it is fair to say, as Commissioner [Neelie] Kroes did when she spoke in Brussels, this does represent the closing of one chapter and gives us the opportunity to open a new chapter. We're definitely enthused about that opportunity and we're committed to ensuring the next chapter is a positive and constructive one.
One of the things that Steve Ballmer talks a lot about in terms of antitrust issues is getting legal clarity on what one can and can't do. Do you feel like you now have that understanding with the EU?
Smith: I think this gives us a great deal more clarity. I think it gives the industry as a whole more clarity. It's perhaps most helpful in the area of interoperability because it really implements a new framework. It applies to a broad array of Microsoft products--Windows, Windows Server, Exchange, SharePoint--and for all of these products it has certain principles that we have to adhere to. It addresses the way we implement file formats.
At the same time, no advance on any single day can ever answer all questions for all companies for all time.
Essentially the EU has said through its very objections that you can't put a media player in Windows and you can't put a browser in Windows. What do you feel Microsoft can include in future versions?
Smith: There are two things to think about. First is what gets included in Windows, and second, what's the right way to address something that is included.
Our basic approach is to include in Windows, software that has APIs (application programming interfaces) that will be beneficial for other applications to call on and use. The browser is definitely an example of that. It's quite probably even more important in that role today than it was, say, when the browser issues first arose in the 1990s. The media player plays a similar role in terms of some broad APIs that are used by a wide variety of other applications.
There are other things that we have put in Windows in the past that don't necessarily involve the same role. A good example of that is Windows Live Messenger. We had Windows Messenger in Windows XP. It's not in Windows Vista or Windows 7 We're trying to make thoughtful decisions about what is included.
Then the second question that arises is how do things get included. How do we document APIs that our browser is using so that other browsers can use them as well? That's part of the U.S. consent decree.
How do we ensure that [computer makers] have flexibility to offer competing choices? How do we ensure that consumers are aware of competing choices and can use them if they wish. That latter part is an area where different governments have chosen different approaches at different times. The U.S. Department of Justice chose one approach in its consent decree. The Korean Fair Trade Commission chose a second approach. The European Commission in the media player case in 2004 chose a third approach. Today's announcement on the browser reflects the European Commission choosing a fourth approach.
Some people have the opinion that as a result of these different antitrust issues, Microsoft really finds itself with one hand tied behind its back as it competes in the battles of today. Do you believe Microsoft in the current antitrust environment competes on an even footing with some of the other Internet giants?
Smith: I do believe it is very important for all technology leaders in our industry to follow the same laws and obey the same rules. The rules don't necessarily apply in the same way when a company has a small market share as it does when a company has a large market share. But there are a number of companies that have large market shares for very important products. We've taken a number of steps to get into line with new legal rules in this field. The law has evolved and we've needed to evolve to address these new obligations.
We do believe our competitors need to play by the same rules. They've often been at the forefront of asking regulators to evolve the law in new directions. Now that the regulators have done so, we believe they need to pay attention as well.
Do you anticipate a period of time over the next few years where Microsoft is more likely to be the subject of antitrust inquiries or the company on the other side of the table for a change?
Smith: I think that we have addressed a very wide array of issues. Perhaps, in part because we were the first company to have to go through these inquiries, at least since the dawn of the PC era. We've probably had to go farther and sooner than other companies have had to do. We're now in an era where a different company seems to be in the headlines for competition law issues, if not every day, at least every month.
I think that what we are going to see in the next decade is this field of law being applied to a wide number of technology leaders that have high market share. We're going to see that, not only in Washington and Brussels, but we're likely to see that in more countries around the world simply because the global economy has evolved.
Have you expressed concerns specifically to Europe or Washington, D.C., about some of Google's behaviors?
Smith: We were very transparent last year when Google entered into its agreement with Yahoo. We felt that that was an illegal agreement that Google had entered into for the sole purpose of preventing Microsoft from becoming a more successful competitor, together with Yahoo, in the search space.
It was only when the Department of Justice informed the parties that it was on the verge of filing suit that Google decided to drop that agreement. We have not been shy about raising concerns when we have them.
It was only a couple hours after you guys settled with Brussels that we heard from D.C. with regards to Intel. When you initially heard that the FTC was filing suit against Intel, did you have feelings of empathy toward what their lawyers are going through, or what were your initial reactions?
Smith: I obviously know from a lot of firsthand experience the challenges that arise when a company needs to address these kinds of issues. Our road was a long one and it had its share of difficult moments. Antitrust issues are never easy for company to address.
This isn't a case where Microsoft has taken a public stance or even voiced to the regulators a position, is it?
Smith: We have not taken any public or nonpublic positions on the issues.
Are you guys looking to reach an agreement with Plurk? You guys said that you used code you shouldn't have? I'm curious if you are trying to negotiate some sort of settlement with them?
Smith: I wouldn't want to say anything that goes beyond the public statement we put out.
It does seem when I look at any particular issue with regards to the Internet, Microsoft tends to have a much more cautious approach. It seems like it is tough to compete when others are bundling more than you.
Smith: I think our goal is to be thoughtful but also fast-moving. As we look at the Internet today, it is increasingly a regulated space. That wasn't the case a decade ago. I think a thoughtful company needs to really think through how its products and services are going to comply with the regulations that are going to be enforced or likely to be applied in many different countries around the world. At the same time, one cannot let that get in the way of moving forward quickly. I think it's striking that balance that is really quite important. One needs to move fast. One shouldn't move faster than speed of thought and yet one shouldn't be so thoughtful that one simply analyzes problems and fails to solve them.
Do you think Microsoft has erred a little too much on side of caution in recent years?
Smith: I don't know that we've erred too much on the side of caution, but I do think it's extremely important we move quickly. This is a very dynamic space it is certain to remain a very dynamic space. Customers are interested in deploying new products and services, whether it is on the client, on the server, or on the cloud. The real key is to develop the capability to be both thoughtful and fast moving.
Microsoft and the European Commission have settled their differences over the choice of Web browsers in Windows.
European Commissioner for Competition Policy Neelie Kroes on Wednesday formally announced a resolution to the Internet Explorer antitrust case against Microsoft. As part of the settlement, Windows PCs sold in the European Economic Area will now present users with a Choice Screen, allowing them to install alternative browsers beyond Internet Explorer.
The Choice Screen will offer users the ability to install up to 12 of the most widely used Web browsers that run under Windows. The choices will include the more widely known browsers, such as IE, Apple's Safari, Google's Chrome, Mozilla's Firefox, Opera, and AOL's browser, and lesser-known products including Maxthon, K-Meleon, Flock, Avant Browser, Sleipnir, and Slim Browser.
Users can download as many of the browsers as they wish or stick with Internet Explorer. Additionally, computer makers and users in Europe will be able to turn off IE totally and set up other browsers as the default. As part of the settlement, Microsoft is also prohibited from preventing the choice of different browsers through any contractual or technical means.
Microsoft initially proposed stripping a browser out of Windows 7 entirely, a move first reported by CNET. Both competitors and the EU balked at that idea though, instead favoring some sort of ballot screen. Microsoft eventually relented, though the company and its rivals have gone back and forth for a while over the details.
Based on feedback it received, Microsoft modified and improved its design, according to the EC. The screen now appears in a neutral window, rather than an Internet Explorer window, and displays the browsers in a random order. The screen itself looks cleaner and less cluttered to the EC, which it believes will help users better focus on making their browser choice.
As part of the overall setup, Microsoft will continue to include IE in Windows but give PC makers the ability to install a different default browser. The Choice Screen will pop up the first time consumers use the default browser, allowing them to pick a different one if they prefer.
Microsoft has promised to make the screen available for five years in the European Economic Area and to offer it for Windows XP, Vista, and Windows 7, according to Europe's antitrust regulators.
"Millions of European consumers will benefit from this decision by having a free choice about which web browser they use," said Kroes. "Such choice will not only serve to improve people's experience of the internet now but also act as an incentive for web browser companies to innovate and offer people better browsers in the future."
Starting six months from now, Microsoft must report regularly to the Commission on its progress in implementing the new commitments, and the Commission can review the commitments two years from now.
After the EU announced the news, Microsoft issued its own statement on the resolution of the long-running, and expensive, antitrust case.
"We are embarking on a path that will require significant change within Microsoft. Nevertheless, we believe that these are important steps that resolve these competition law concerns," Microsoft general counsel Brad Smith said in the statement. "This is an important day and a major step forward, and we look forward to building a new foundation for the future in Europe."
The U.S. Justice Department, which waged its own years-long antitrust battle with Microsoft, applauded the outcome of the EU's case.
"As we understand it, the settlement is based on measures to enhance competition and is designed to preserve industry participants' incentives and ability to compete going forward. A settlement that helps to clarify obligations under European law allows the industry to move forward," Christine Varney, assistant attorney general in the Justice Department's antitrust division, said in a statement.

Microsoft has begun a campaign to actively urge users of its 8-year-old Internet Explorer 6 browser to upgrade.
After launching IE 8 in March, Micosoft has concurred with critics that IE 6 is outdated. Many people have dropped the older browser, but the remaining users are often the tough cases--those who don't have a choice because of corporate computing policy or who aren't tech-savvy enough to realize there's a reason to move on.
This eBay 'Web slice'--basically a live bookmark in Internet Explorer 8--is part of Microsoft's effort to get people to upgrade from IE 6.
(Credit: Screenshot by Stephen Shankland/CNET)It's this latter population Microsoft is targeting with a campaign that runs through June 2010 that touts its own IE 8 as a better alternative. The campaign's first visible elements are a video aimed at online holiday shoppers and a Web slice to promote daily deals at eBay. Web slices are basically live bookmarks that can show miniature Web pages in the browser.
"What we're doing with the outreach is help users understand how to protect themselves against social engineering threats that exist and to help people understand how Internet Explorer 8 puts people in control of their own privacy online," said Ryan Servatius, senior product manager for Internet Explorer. Security was one of the big problems with IE 6, and Microsoft now boasts that security features in IE 8 block 2 million malware sites a day.
According to Net Applications' statistics, Internet Explorer 6 is still the most widely used browser, with 23.3 percent share of usage in October, followed by IE 7 at 18.2 percent and IE 8 at 18.1 percent. The newer browsers are gaining on IE 6, but so are rivals including Mozilla's Firefox, Apple's Safari, and Google's Chrome.
Web developers often gripe about having to support IE 6, which doesn't support many modern features for more sophisticated Web sites and even applications. Microsoft acknowledges that it's holding back development of the Internet, too.
"The best thing a user can do to advance the Web is to help move people off IE 6," Servatius said.
Of course, many will upgrade to IE 8 by buying Windows 7. IE 6 was the browser that shipped with Windows XP, which remains entrenched, but there are signs Windows 7 is a more compelling successor than Windows Vista. That could help the corporate customers move away from IE 6, Servatius said.
"As enterprises migrate from whatever operating system they're using today to Windows 7, that's going to help deprecate IE 6," he said. "What we're doing is working both with consumers worldwide and IT professionals to help them understand what the benefits of a modern browser are."
With Internet Explorer 9, Microsoft showed Wednesday it's trying to retake the browser initiative.
IE remains the Net's dominant browser. But perversely, it became something of a technology underdog after Microsoft vanquished Netscape in the browser wars of the 1990s and scaled back its browser effort.
That left an opportunity for rivals to blossom--most notably Firefox, which now is used by a quarter of Web surfers, but also Apple's Safari, which now runs on Windows as well as Mac OS X, and Google's Chrome, which aims to make the Web faster and a better foundation for applications.
Microsoft has been pouring resources back into the IE effort, though, and at its Professional Developers Conference in Los Angeles, some fruits of that labor were on display. In particular, Windows unit president Steven Sinofsky showed off IE 9's new hardware-accelerated text and graphics.
The acceleration feature takes advantage of hitherto untapped computing power in a way that's more useful than other browser-boosting technology--Google's Native Client to directly employ PC's processor and Mozilla's WebGL for accelerated 3D graphics, for example--according to Dean Hachamovitch, general manager of Internet Explorer.
"This is a direct improvement to everybody's usage of the Web on a daily basis," Hachamovitch said in an interview after Sinofsky's speech. "Web developers are doing what they did before, only now they can tap directly into a PC's graphics hardware to make their text work better and graphics work better."

The software maker is also not planning to announce a move to the WebKit engine, as some had speculated.

(Credit: Ina Fried/CNET)In his opening keynote at the Professional Developers Conference on Tuesday, Chief Software Architect Ray Ozzie pledged that Microsoft will make Internet Explorer the absolute best Windows browser, but did not offer further details.
Microsoft is expected to talk more about its browser plans as part of Wednesday's keynote speech. During that talk, he is expected to talk about some--but not all--of its "focus areas" for the next browser version, a Microsoft representative told CNET.
The latest version of IE 8 was released in March and is also built into Windows 7. Despite the new release, though, Microsoft faces intense competition from Firefox as well as from Google and Apple.
In addition, Microsoft has struggled to get Internet Explorer users to move past IE 6.
Mozilla on Friday disabled a Microsoft plug-in for Firefox called the .Net Framework Assistant because of a security problem--then scrambled to give people with patched systems an override option.
Mike Shaver, Mozilla's vice president of engineering, announced the first step late Friday night on his blog. "It's recently surfaced that it has a serious security vulnerability, and Microsoft is recommending that all users disable the add-on," Shaver said. "Because of the difficulties some users have had entirely removing the add-on, and because of the severity of the risk it represents if not disabled, we contacted Microsoft today to indicate that we were looking to disable the extension and plug-in for all users via our blocklisting mechanism. Microsoft agreed with the plan, and we put the blocklist entry live immediately."
This warning sign greeted Firefox users after Mozilla blocked use of a Microsoft add-on.
(Credit: Screenshot by Stephen Shankland/CNET)The .Net Framework Assistant add-on lets Firefox use Microsoft's ClickOnce technology for installing applications that run on its .Net programming foundation. The add-on already was something of a thorn in the sides of some Firefox users: it was automatically installed via Windows Update with the .Net Framework 3.5 Service Pack 1 without telling the user the add-on was being installed or giving an option. More hackles were raised because it wasn't compatible with Firefox 3.5, Shaver said, and because removing it initially required people to edit their Windows Registry--a technically onerous task for most people.
Firefox checks a Mozilla server periodically for a list of add-ons to avoid. Although Mozilla's blocking move was intended to protect users, it caused other problems. Shaver indicated that Firefox's changed behavior irked some system administrators.
That led Justin Angel, a former Silverlight program manager at Microsoft, to tweet, "When business users can't use their core business functionality--they uninstall stuff."
One issue was that Mozilla's add-on blocking technology couldn't tell if people had patched their software and so weren't vulnerable anymore. "We can't distinguish patched from unpatched, so we're blocking it while we sort that out," Shaver twittered. Over the weekend, Mozilla worked to remedy the situation.
"Pushing a change to our blocklist software that will let Firefox 3.5 users override the blocking of .NET FA/WPF plugin if they're patched," Shaver tweeted Sunday. But a few hours later, he added, "We're still working on the blocklist tweaks to help enterprises override the blocking of the WPF plugin, stay tuned!"
Update 6:47 p.m. PDT: Crisis partially averted, apparently. At about 6:10 p.m., Shaver tweeted, "MSFT confirmed that the .NET Framework Assistant is not exploitable, so we've removed it from the blocklist; one down!"
Update 8:34 p.m. PDT: There's still another blocked Microsoft add-on that's vulnerable, one that concerns the Windows Presentation Foundation (WPF), which also is installed with the .Net service pack. Shaver said it was more serious.
"We're hard at work on improving the experience for (especially enterprise) users who wish to override the blocking of the WPF plugin before we remove it from the blocklist," Shaver said in a Sunday night blog post that announced the other plug-in had been removed from the Firefox blocked add-on list.
Programmers have mostly overcome a crucial hurdle to releasing a beta version of Chrome for the Mac, printing support, but several Windows 7 features won't make the cut for the present 4.x version of Chrome.
The Mac printing support is now added, according to the Google browser's issue-tracking system, though there are "minor remaining issues" and the new features aren't yet distributed with the software.
Google has cited Mac printing support as one holding back a Mac version of the browser. Mac support is important for the company's ambitions to spread the browser and its fast-Web philosophy to mainstream users. The Linux version, while less mainstream now, also is important since it's the foundation of Google's Chrome OS project to build a browser-based operating system for Netbooks.
But on the Windows side of the shop, a number of planned features to support Windows 7 were pushed back to the next version Chrome on Wednesday. That includes support for showing thumbnails of open tabs on the task bar, showing "jump lists" for quick actions such as links recently or frequently visited pages, pinning thumbnails to the task bar, and overlaying a download progress status bar on the Chrome icon.
The present beta and stable releases that Google issued Monday, Chrome version 3.0.195.27 (download for Windows only), are members of the 3.x family. The developer preview is in the 4.x family (download for Windows or Mac OS X). The Windows 7 features had been slated for the 4.x series, but now are planned for version 5, according to the issue-tracking system.
The change doesn't indicate the features have retreated into the distant future, though; Chrome version numbers change relatively rapidly, as evidenced by the move to version 4 in just over a year.
Also pushed back to the 5.x series is built-in support for discovering when Web pages have RSS feeds, one of Chrome's most-requested features. Its absence is ameliorated by a Chrome sample extension for RSS, though.
Extensions remain a work in progress. New ones are arriving steadily, and existing extensions such as Lastpass for filling in passwords and forms and AdSweep for blocking ads is progressing. But Google recently switched interfaces, dropping the use of a toolstrip across the bottom of the browser with pop-up "moles" in favor of browser actions, small icons along the top of the browser.
European Union regulators said Wednesday that Microsoft can go ahead and start using its latest proposed "ballot screen," which will let new users of Windows choose which browser--or browsers--they wish to use.
The decision to let Microsoft "market test" the latest version would seem to mark the wrapping up of the latest antitrust skirmish with Brussels.
More than a decade after Microsoft first started including a browser with Windows, regulators said earlier this year that they had reached the preliminary view that such an inclusion violated European antitrust law.
In response, Microsoft initially said it would ship Windows 7 in Europe without a browser at all, seemingly challenging the logic of the decision by the European Commission, the executive arm of the EU. However, amid indications that such a move would not fly, Microsoft in July offered a proposal that more closely matched what regulators and competitors wanted--a ballot screen that lets users choose which browser or browsers they wish to install.
Since then Microsoft, regulators, and competitors have been going back and forth about how that screen would look and operate.
"The improvements that Microsoft has made to its proposal since July would ensure that consumers could make a free and fully informed choice of web browser," Europe's antitrust authority said in a statement. Among the changes since Microsoft's July proposal is the agreement by Microsoft to add more information before users select a browser. Microsoft will now first present users with a screen explaining what a browser is and will then offer "Tell me more" buttons for each browser.
Under the revised proposal, Microsoft would, through Windows Update, make available for five years in the European Economic Area a screen allowing users of Windows XP, Windows Vista, and Windows 7 to choose which Web browsers they want to install. PC makers will also be able to install competing Web browsers and, if they choose, set those as the default browser and disable Microsoft's Internet Explorer.
"The Commission's preliminary view is that Microsoft's commitments would address these competition concerns and is market testing Microsoft's proposal in light of these requirements," The EC said in its statement.
For its part, Microsoft said it welcomed the European Commission's decision.
"For Microsoft, today's decision is a significant step toward closing a decade-long chapter of competition law concerns in Europe," general counsel Brad Smith said in a statement.

After a few hours on Tuesday of playing with the Zune HD that Microsoft sent me, I found a lot of things I like about it--the slim size, the Quickplay user interface feature that gives you immediate access to recently added and favorite songs, the big on-screen volume controls, and the Zune Pass, for example. But the Web browser seems like an afterthought.
CNET's Donald Bell had better luck with the on-screen keyboard than I did.
(Credit: Donald Bell/CNET)I know that mobile Web browsing isn't the same as PC browsing, but I've used Safari on the iPhone for more than a year, and it's great--I actually read articles, for work and fun, on my bus commute to work. It's so good, I've been taking it for granted. Not anymore.
Microsoft says the Zune HD's browser is based on the mobile version of Internet Explorer, but it doesn't look like any version of IE I've ever seen. The address bar is hidden--you have to pull up on the gray bar at the bottom of the screen to get to it. The other alternative is to click on a small magnifying glass to conduct a search on the mobile version of Bing, which I found difficult to use. (No slam against the full browser-based version of Microsoft's search engine, which I like.) For instance, when I conduct a search on my employer's name, "Directions on Microsoft," Bing Mobile assumes I want news stories that cite the company, when in fact I just want our home page. There's a link on the Bing Mobile site that says "web," which I assume is supposed bring me general search results from around the Web, but when I clicked it repeatedly, nothing happened. There's also no auto-suggest or auto-complete for search queries--each time you want to search for "Chinese restaurants," you have to type the whole query in.
Regardless of how you're trying to navigate, the on-screen keyboard seems to require more finger accuracy than the fault-tolerant keyboard on the iPhone (probably because of the smaller screen). The back button is hard to hit--I kept selecting the favorites menu by mistake. Sites are also considerably slower to load, and the resolution doesn't seem to be nearly as good as the iPhone or iPod Touch, with a noticeable flicker on pages with white backgrounds.
Maybe it's just me--Donald Bell thought the browser was great--but I can't imagine using this browser for any length of time.
Artists put the finishing touches on a replica of the Golden Gate Bridge constructed from soup cans. The June stunt was aimed at drawing awareness to Microsoft's Browser for the Better campaign, in which the software maker is donating to a food bank for each download of Internet Explorer 8.
(Credit: Microsoft)Microsoft is extending a promotion that is designed to spur downloads of Internet Explorer 8 with the promise of donating food to the hungry.
The "Browser for the Better" effort kicked off in June. Under the plan, Microsoft was donating $1.15 in food for each download completed through the program's Web site, up to a maximum of $1 million.
The program was slated to end early this month. However, Microsoft never took the site down and announced formally last week that it is extending the promotion through the end of September.
Microsoft declined to say how many downloads the promotion has received, but the site's Web site reflects the updated deadline and still says that Microsoft will donate a maximum of $1 million.
Besides extending the deadline, the software maker is making one other change to the program--doubling the donation per download (to $2.30) for those who are moving from IE 6. Microsoft has said it would like to persuade more users to move off IE 6, but must nonetheless support those who choose to remain with the years-old browser.
According to Net Applications, IE 6 has 27 percent of the global browser market, as compared with 23 percent for IE 7 and more than 12 percent for IE 8. Various versions of Firefox account for 22 percent of the market, while Apple's Safari holds 4 percent market share.
The Browser for the Better push is just one of many ways that Microsoft is promoting IE 8, including a promotion with Nickleback as well as the boring-but-effective methods of pushing it out through Microsoft's automatic updating mechanisms.
Firefox launched the latest update to its browser, Firefox 3.5, in June.
