Some eBay customers had trouble accessing parts of the auction site Monday, the company said. The problems started about 1:30 p.m. PT, and were still ongoing as of 4:25 p.m. PT, the company said. Customers primarily had problems downloading or viewing images on eBay's site because of the problem, which eBay was still trying to diagnose Monday afternoon. The site slowdown is intermittent and is not affecting every user, eBay spokesman Kevin Pursglove said.
Last Thursday, eBay suffered a 90-minute outage, its first significant downtime in more than a year. Although eBay has identified the cause of the outage, Pursglove declined to say what it was. The outage is not related to Monday's site slowness and neither problem is related to the company's V3 upgrade of its systems, he said.
eBay customer support is basically non existing. They continue to depend on their Sellers to trouble shoot and find the problems with their software even Beta versions.
I feel that when you agree to eBay Policy you do so with the understanding that eBay will provide services in return, this goes will beyond a two weeks time frame.
A seller can pay for services, never get them, ask for a refund,
eBay reaction is to ignore you, or suspend you.
So Company spokesman Kevin Pursglove is correct you can apply, but with serious consequences
The unfortunate problem is of course there are many eBay sellers and their families that have become financially dependant on their revenues as any retailer would. These are very nice hard working people.
Kevin Pursglove should have also told you that the majority of sellers are simply afraid to do anything or say anything in fear of reprisal from eBay or PayPal

I will never sell on eBay again, I will buy from those that are able to get their product posted, but I expect eBay to any moment cut my account off in reprisal to my attitude.
Which Sir is simply they are a company no more no less, and to their great surprise I believe they are subject to the same civil law as you and I.
eBay has taken the word "policy" to now mean civil law by eBay.
Last but not least Mr. Kevin Pursglove is a prefect example of the the typical Public Relation strategies attached to eBay, which sound like a good neighbor, read the Blogs, and forums you will see that that is not true.
Look at eBay stock charts each January for the past three years it hits it high then down it goes.
I have great sympathy for the sellers that have become dependant on eBay
