Deposition day for Gates

Microsoft chief executive Bill Gates is set to be deposed today and maybe tomorrow as well in the antitrust lawsuit filed against the software giant, according to a spokeswoman for New York Attorney General Dennis Vacco.

today first surfaced last week. He is expected to be deposed at Microsoft's headquarters in Redmond, Washington.

Attorneys for Vaco will begin the questioning on behalf of the states that are suing Microsoft. Questioning from Justice Department attorneys will follow.

The session is being videotaped.

Regulators and Microsoft have been arguing about how long Gates will be deposed. The U.S. District Court judge hearing the case ultimately sided with the DOJ, meaning regulators have no time limit for completing their questioning.

Depositions from more than a dozen other Microsoft executives will be taken as well. The trial is set to begin on September 23.

Microsoft declined comment.
